Accused in attempt to murder case released on bail

Justice VM Deshpande while hearing the matter through video conferencing has granted bail to  Syed Sameer, Sheikh Ilyas, Sheikh Nadim, Sheikh Irshad.

They were arrested for the alleged offence punishable sections u/sec 307, 504, 34 Of IPC R/W Sec 4, 25 Of Arms Act registered dated 13 april 2020 by the non-applicant on the report of the complainant Imran Khan Samaulla Khan for the alleged offence punishable sections u/sec 307, 504, 34 Of IPC R/W Sec 4, 25 Of Arms Act registered dated 13 april 2020 by the non-applicant on the report of the complainant Imran Khan Samaulla Khan.

The case of prosecution was that, complainant Imran Khan Samaulla Khan in his report has alleged that, on 13-04-2020 at about 2 pm, the work of drainage repair was going on in front of the house of Imran Khan Salamulla Khan at that time, Salamullah Khan came and told the contractor to not to put block on the drainage and he should cover the drainage completely. At that time, Syed Nadeem came and quarreled with Salamullah Khan and therefore, Asif Khan, Shahzad Khan and Ezaz Khan came to the rescue of his father and tried to give understanding to Syed Nadeem but Syed Nadeem went inside his house and brought sword with his brother Sameer. That, Syed Irshad brought iron pipe and Syed Ilyas brought wooden rafter. Syed Nadeem and Syed Sameer assaulted Salamullah Khan on his head and hand by sword and injured him. Syed Irshad and Syed Ilyas assaulted Ezaz Khan by iron pipe and wooden rafter on his hand. Syed Sameer assaulted Ezaz Khan by sword on his head.

It was contended that, there was a counter crime registered against complainant party for offence under sec 307 of ipc. The dispute was due to construction of drainage line. It was submitted that, taking into consideration the injuries suffered by the injured no case is made out attracting sec 307 of IPC.Adv Mir Nagman Ali,
